 These Terms of Service (“Terms”, “Agreement”) govern the use of the website ehaairah.com (“Website”, “Site”) and all transactions, products, and services offered by Ehaairah Boutique (“Ehaairah”, “Company”, “we”, “us”, “our”). By accessing, browsing, or purchasing through this Website, you (“Customer”, “User”, “Purchaser”, “Client”) acknowledge that you have read, understood, and agreed to be bound by these Terms, as amended from time to time without prior notice.

1.1 All garments, accessories, and designs displayed on this Site, or communicated via social media or promotional material, are presented for illustrative purposes only.
1.2 Actual products may vary in shade, hue, brightness, contrast, texture, hand-feel, embroidery density, or embellishment quality owing to — but not limited to — differences in screen calibrations, photographic lighting, natural dye variations, artisan workmanship, and fabric batch production.
1.3 The User expressly acknowledges and agrees that such variations shall not constitute a defect, misrepresentation, or grounds for dispute.

2.1 Prices are deliberately not published online, as fabrics, trims, and artisanal processes are inherently variable and subject to market availability, currency fluctuations, and seasonal demand.
2.2 The binding price for any order shall be the price communicated and confirmed at the time of purchase. Discounts, offers, and promotional schemes may apply exclusively at our discretion.
2.3 Ehaairah reserves the unconditional right to alter, amend, substitute, or discontinue any design, embellishment, stitching method, or production process without prior notice, and such modifications shall not be construed as a breach of contract.

3.1 Orders shall be deemed valid only upon explicit confirmation by Ehaairah, which may include issuance of an invoice, receipt of full or partial payment, or written acknowledgment.
3.2 We exclusively accept domestic orders within the territory of the Republic of India. Any attempt to place or process an international order will be void ab initio and shall not be honored.
3.3 Payments must be effected through approved channels. Failure to remit payment within the stipulated timeframe will result in automatic cancellation of the order.

4.1 Given the bespoke and handcrafted nature of our products, all sales are final. Returns and exchanges shall be permitted solely in cases of material defect or gross deviation from the order specification.
4.2 Minor inconsistencies in color, embroidery, size tolerance, or embellishment shall not qualify as grounds for return.
4.3 The Customer bears the burden of proof. Any claim for defect or damage must:

• (a) Be submitted in writing to Ehaairah within 48 hours of delivery;
   
• (b) Include a single, continuous, unedited video recording demonstrating (i) the unopened parcel, (ii) intact courier seals, (iii) the uninterrupted unboxing process, and (iv) immediate inspection of the product.
  4.4 Still photographs, multiple short videos, or edited clips shall not constitute admissible evidence.
  4.5 Claims submitted without such continuous video evidence shall be summarily rejected, and the Customer hereby waives the right to contest such rejection.
   

5.1 By accessing or using this Site, you expressly consent to the collection, processing, and storage of basic personal data, including but not limited to name, contact number, shipping details, and order history.
5.2 Such data may be used by Ehaairah for purposes including, but not limited to, order fulfillment, customer communication, marketing analytics, service enhancement, and compliance with legal obligations.
5.3 Data may be shared with third-party service providers strictly on a need-to-know basis for payment processing, logistics, and statutory compliance.
5.4 The Company disclaims liability for data breaches arising from circumstances beyond its reasonable control, including but not limited to unauthorized third-party access, hacking, or force majeure events.

6.1 All trademarks, trade dress, logos, photographs, patterns, sketches, designs, and content appearing on this Site are and shall remain the exclusive intellectual property of Ehaairah.
6.2 Unauthorized reproduction, duplication, distribution, or commercial exploitation of any such intellectual property shall constitute infringement and may result in civil and/or criminal proceedings.

7.1 To the fullest extent permitted by applicable law, Ehaairah shall not be liable for:

• Delays in delivery attributable to third-party courier services;
• Customs, strikes, natural disasters, or force majeure events;
• Incorrect measurements, addresses, or information supplied by the Customer.

7.2 In no event shall Ehaairah’s liability exceed the actual amount paid by the Customer for the specific order in question.
 

8.1 Ehaairah reserves the right, at its sole discretion, to amend, modify, or replace these Terms at any time without advance notice.
8.2 Continued use of the Site or placement of orders following such amendments constitutes acceptance of the revised Terms.
8.3 No waiver of any right or provision under these Terms shall be deemed a continuing waiver of such right or any other provision.

9.1 These Terms shall be governed by and construed in accordance with the laws of India.
9.2 Any disputes, claims, or controversies arising out of or relating to these Terms, the Site, or any transactions shall fall under the exclusive jurisdiction of the competent courts in Kochi, Kerala.

By using this Website or purchasing from Ehaairah, you confirm that you have read, understood, and agreed to be bound by these Terms of Service, regardless of whether you have actually read them in full.
